Material Misrepresentation

A material misrepresentation is a false or misleading statement made on an insurance application that, if known, would have caused the insurer to decline coverage, charge a higher premium, or impose different terms.

Material misrepresentation is one of the most serious grounds for policy rescission—the insurer's retroactive cancellation of the policy as if it never existed. When an apartment owner applies for insurance, the application asks questions about the property's age, construction type, occupancy, loss history, protective safeguards, prior cancellations, and other underwriting factors. If the owner provides false or materially inaccurate answers—whether intentionally or through carelessness—and the insurer later discovers the truth, the insurer may void the policy and deny all pending claims.

For apartment owners, common misrepresentation issues include understating the age of major building systems (roof, plumbing, electrical, HVAC), failing to disclose prior claims or losses, misrepresenting occupancy rates or tenant demographics, omitting known code violations, and inaccurately describing the building's construction class. Even unintentional errors can constitute material misrepresentation if the information would have changed the insurer's underwriting decision. The test is materiality, not intent: a statement is material if a reasonable underwriter would have made a different decision based on the truth.

The consequences of material misrepresentation extend beyond policy rescission. If a loss occurs and the insurer rescinds the policy, the owner is left without coverage for potentially millions of dollars in property damage and liability claims. Additionally, the rescission goes on the owner's insurance record, making it extremely difficult and expensive to obtain coverage in the future. Apartment owners should review their applications carefully, ensure all responses are accurate and complete, and promptly notify the insurer of any material changes that occur during the policy period.
