Fire Legal Liability

Fire legal liability coverage pays for damage to premises rented to or occupied by the insured when the damage is caused by fire, protecting the insured's legal obligation to the property owner.

Fire legal liability is a coverage component within the commercial general liability policy (ISO form CG 00 01) that responds when the insured is legally liable for fire damage to premises they rent or temporarily occupy. For apartment owners, this coverage is most relevant in two scenarios: when the owner leases commercial space within a mixed-use apartment building (such as a ground-floor retail unit), and when the owner rents temporary office or storage space for their management operations.

The standard CGL policy includes fire legal liability with a default limit, often $100,000. For apartment owners who lease commercial space as tenants—for example, a leasing office in a building they do not own—this limit may be insufficient if a fire originating in their space damages the landlord's building. Increasing the fire legal liability limit is typically inexpensive and should be sized to reflect the replacement cost of the space being occupied.

From the apartment owner's perspective as a landlord, fire legal liability is more relevant as a requirement to impose on commercial tenants within mixed-use buildings. If a restaurant or retail tenant causes a fire that damages the apartment building, the tenant's fire legal liability coverage provides a recovery source for the apartment owner's insurer through subrogation. Lease agreements for commercial tenants in apartment buildings should specify minimum fire legal liability limits and require the tenant to name the building owner as additional insured.
