Negligence

Negligence is the failure to exercise the level of care that a reasonably prudent person or entity would exercise under similar circumstances, resulting in harm or damage to another party.

Negligence is the legal theory underlying the vast majority of liability claims against apartment building owners. To establish negligence, a claimant must prove four elements: the property owner owed a duty of care to the injured party, the owner breached that duty, the breach caused the injury, and the injured party suffered actual damages. For apartment owners, the duty of care extends to tenants, their guests, delivery personnel, contractors, and in many jurisdictions, even trespassers under certain circumstances.

Common negligence claims against apartment owners include slip-and-fall injuries from icy walkways or wet floors, injuries caused by defective handrails or stairways, assaults resulting from inadequate security (foreseeable crime theory), dog bites in buildings that allow pets without breed restrictions or liability requirements, carbon monoxide exposure from faulty heating systems, and injuries from poorly maintained elevators or pool areas. Each of these claims rests on the allegation that the owner knew or should have known about the hazard and failed to address it.

The commercial general liability policy is the primary coverage that responds to negligence claims against apartment owners. It pays both the cost of defending the claim (under the insurer's duty to defend) and any settlement or judgment up to the policy limit. Apartment owners can reduce negligence exposure through regular property inspections, prompt maintenance response, documented repair protocols, adequate lighting, proper snow and ice removal, and clear safety signage. These measures not only reduce claim frequency but also strengthen the owner's legal defense if a claim is filed.
