Does apartment insurance cover bed bug infestations?

Most standard property and liability policies exclude pest infestations, including bed bugs. Some specialized endorsements may provide limited coverage.

Standard commercial property and general liability insurance policies typically exclude damage caused by insects, vermin, and pests, including bed bugs. The ISO Commercial Property Causes of Loss forms specifically list "insects, birds, rodents, or other animals" among their standard exclusions. This means the cost of extermination, replacing contaminated furnishings in common areas, and lost rental income from affected units is generally not covered by a standard apartment insurance policy.

However, the liability exposure from bed bugs can be significant. Tenants may file claims alleging that the landlord's negligence (failure to address known infestations, failure to treat adjacent units, or renting a unit with an existing infestation) caused them physical harm or property damage. Whether general liability responds to such claims depends on the specific policy language, the nature of the allegations, and the applicable state law. Several states and municipalities have enacted bed bug disclosure and treatment laws; for example, New York City Administrative Code § 27-2018.1 requires landlords to disclose bed bug infestation history and notify tenants of infestations, while Chicago's Residential Landlord and Tenant Ordinance (§ 5-12-110) places the treatment obligation on the landlord.

Some insurers offer bed bug endorsements or specialty policies that cover treatment costs, lost rental income during treatment, and tenant property damage claims. Apartment owners in regions where bed bug problems are common may want to explore these options. Regardless of insurance coverage, a proactive bed bug prevention and response program (including regular inspections, prompt treatment, and clear tenant notification procedures) is essential for managing this risk.
