Rate Filing

A rate filing is a formal submission by an insurance company to the state insurance department requesting approval to use specific premium rates for a particular line of insurance.

Rate filing is the regulatory process through which insurance companies establish the premiums they charge for coverage. In the United States, insurance regulation is primarily a state function, and each state's department of insurance oversees rate filings within its jurisdiction. States follow one of three regulatory approaches: prior approval (rates must be approved before use), file-and-use (rates are filed and can be used immediately but are subject to subsequent review), or use-and-file (rates can be used first and filed afterward within a specified period).

For apartment building owners, rate filings directly affect the premiums they pay. When an insurer files for a rate increase—citing higher loss experience, increased reinsurance costs, or rising construction expenses—the state regulator reviews the filing for actuarial justification. If approved, the rate increase applies to all new and renewal policies in that state. Apartment owners in states with prior approval systems may benefit from regulatory delays that slow the implementation of rate increases, while owners in use-and-file states may see increases take effect more quickly.

Understanding the rate filing process helps apartment owners contextualize premium changes at renewal. A carrier that announces a 15% rate increase across its apartment book is responding to portfolio-level loss trends, not penalizing an individual property. Owners who receive rate increases should ask their insurance advisor whether the increase reflects a filed rate change (affecting all policyholders) or an individual account adjustment based on the property's own loss experience, occupancy changes, or underwriting factors. This distinction informs the renewal negotiation strategy.
